Network/Internet User Agreement

BY ACCESSING, VIEWING, OR USING ANY MATERIAL OR CONTENT ON THE SITE, YOU, USER, AGREE THAT YOU HAVE READ AND UNDERSTAND THE INFORMATION AND THIS USER AGREEMENT, AND INTEND THE USER AGREEMENT TO BE THE LEGAL EQUIVALENT OF A SIGNED, WRITTEN LEGAL CONTRACT BETWEEN YOU AND RCIS, INC. YOUR USE OF THE SITE SIGNIFIES YOUR ACCEPTANCE OF THE TERMS OF THIS USER AGREEMENT AND YOU AGREE TO BE LEGALLY BOUND BY THEM WITHOUT LIMITATION OR QUALIFICATION.

Introduction

We are pleased to offer staff, volunteers and interns of the Red Cloud Indian School, Inc. (RCIS) access to the computer network resources, and the Internet. To use these resources, staff, volunteers and interns must agree to this form. Please read this document carefully, and review its contents. Any questions or concerns about this online form or any aspect of the computer network should be referred to the Director of Information Technology.

General Network Use

The network is provided for staff, volunteers and interns to support business activities, research and projects. Access to network services is given to staff, volunteers and interns that agree to act in a considerate and responsible manner. Staff, volunteers and interns are responsible for good behavior on RCIS computer networks. To ensure the use of electronic communication systems at RCIS are compliant with this agreement, network administrators may monitor usage of RCIS purchased equipment from time to time. Access is a privilege - not a right. As such, general rules for behavior and communications apply and users must comply with district standards and honor this agreement.

Network storage areas may be treated like school lockers. Network administrators may review files and communications (i.e. computers, emails, chat, and instant messaging) to assure that they are used appropriately and to maintain system integrity and ensure that users are using the system responsibly. Users should not expect that files stored on RCIS servers to ever be private, as electronic systems are not personal property, including internet, staff/students have no expectation or right of privacy related to their use of RCIS Electronic Communication Systems.

Internet / World Wide Web

Access to the Internet will enable staff to use thousands of libraries and databases. Within reason, limited freedom of speech and access to information will be honored. Staff, volunteers and interns should be warned that some material accessible via the Internet might contain items that are illegal, defamatory, inaccurate or potentially offensive to some people. While our intent is to make Internet access available to further educational goals and objectives all information found on the Internet should be considered suspect until confirmed by another reliable source. There is no quality control process on the Internet, and a considerable amount of its information is outdated or inaccurate.Filtering software is in use, but no filtering system is capable of blocking 100% of the inappropriate material available on the Internet. Access to the Internet by personnel that is inconsistent with business needs results in the misuse of resources. These activities may adversely affect productivity due to time spent using or "surfing" the Internet. Additionally, RCIS may face loss of reputation and possible legal action through other types of misuse. Access to the Internet will be provided to users to support business activities only and to perform their jobs and professional roles.

Publishing to the World Wide Web

Staff, volunteers and interns, your work may be considered for publication on the World Wide Web, specifically on RCIS various web sites. Such publishing requires your permission. Notwithstanding the foregoing, to the extent your original work is in performance of your contract with RCIS, it is considered a work for hire and RCIS has copyright interests in the material. The work will appear with a copyright notice prohibiting the copying of such work without express written permission. In the event anyone requests such permission, those requests will be forwarded to you and the administration.

Email

All employees, volunteers and interns are required to use RC Mail for all RCIS related business. Email, Instant Messaging, Chat, Text Messaging using RCIS supplied equipment should be courteous, professional, and business oriented if permitted. What seems humorous as it is being written may not be humorous when read by the recipient, whether inside or outside of RCIS. Email, Chat, or Instant Messaging to anyone will not be tolerated if it is interfering with normal duties and could lead to termination of usage if abused. Employees, volunteers and interns may not disclose or use proprietary or confidential information except as required by their jobs, security must be used at all times to protect confidentiality. Disclosure includes electronic transmission of information. Anyone who violates this policy will be subject to discipline and possible legal recourse for such things as defamation and stalking. Using a reasonable amount of RCIS resources for personal emails is acceptable, but non-work related email should be saved in a separate folder from work related email. Sending chain letters or joke emails from a RCIS email account is prohibited. RCIS Director of Technology shall approve virus or other malware warnings and mass mailings from RCIS before sending. These restrictions also apply to the forwarding of mail received by a RCIS employee.

The following activities, although not all inclusive, are not permitted while using the computer network resources, and the Internet:

  1. Sending or displaying offensive messages or pictures.
  2. Using obscene language, defamatory, offensive or harassing via any electronic communication (email, chat, text messaging, or websites).
  3. Giving personal information, such as complete name, phone number, address or identifiable photo, without permission from teacher and parent or guardian.
  4. Harassing, insulting or attacking others.
  5. Damaging or modifying computers, computer systems or computer networks will result in monetary charges related to repair, replacement or re-configuration.
  6. Installing or attempting to install any program, game or application not approved by the administration.
  7. Violating copyright laws.
  8. Using other employee's passwords.
  9. Trespassing in others folders, work or files.
  10. All non-work related Chat Rooms, Multimedia Downloads, Software downloads.
  11. Social Networking Websites are Blocked and not allowed access on the RCIS networks, unless it is for business related purposes.
  12. Employing the network for commercial purposes, financial gain, or fraud.
  13. Accessing and playing games not approved by the teacher or administration.
  14. Hacking sites, games or gambling sites, and bypassing blocked sites through proxy servers (violations may result in a loss of access as well as other disciplinary or legal action).

As a user of the RCIS computer network, by accessing this network, I hereby agree to the terms and conditions of the this network/internet user agreement, to honor all relevant laws and restrictions, and grant permission to use my name for staff, volunteers and intern listing and be published to the World Wide Web. In consideration of being allowed to access the network and internet on RCIS equipment at no cost to myself, I hereby waive any and all right or expectation of privacy I may have under state or federal law with respect to any material, including without limitation, email, instant messaging, document storage, usage history, and access to such material by Red Cloud Indian School, Inc.

TERMS OF USE:

These "Terms of Use" govern your use of this MyRedCloud Web Site, (the "Site"). BY ACCESSING, VIEWING, OR USING ANY MATERIAL OR CONTENT ON THE SITE, YOU, USER, AGREE THAT YOU HAVE READ AND UNDERSTAND THE INFORMATION AND TERMS OF USE, AND INTEND THE TERMS OF USE TO BE THE LEGAL EQUIVALENT OF A SIGNED, WRITTEN LEGAL CONTRACT BETWEEN YOU AND RED CLOUD SCHOOL, INC. YOUR USE OF THE SITE SIGNIFIES YOUR ACCEPTANCE OF SUCH TERMS OF USE AND YOU AGREE TO BE LEGALLY BOUND BY THEM WITHOUT LIMITATION OR QUALIFICATION.

As used in this Terms of Use, the term "you" or "yours" refers to any individual using the Site, including each person designated by Red Cloud School, Inc. ("RCIS") as having permission to use the Site as either an employee, student, parent of student of RCIS or another authorized user ("Authorized User"). Only Authorized Users may use the Site.

You and all Authorized Users of the Site agree to follow RCIS's user ID and password notification procedures. All user IDs and passwords must be kept private and confidential.

RCIS has the right to audit your use of the Site at any and all times.

RCIS may deny access to the Site and any associated information systems to anyone at any time in its discretion.

RCIS reserves the right to access, read, copy, delete and disclose information on the Site and to inspect any and all files stored or transmitted via the Site.

Authorized User shall not use the Site in a manner which may violate the laws and regulations of the United States or any other nation, or the laws and regulations of any State, City, Province or other jurisdiction in any fashion. Authorized Users that are employees of RCIS, Inc. agree to take no actions that violate RCIS's Internet use policy.

Authorized User shall maintain in strictest confidence and shall not use or disclose outside of its own company any information posted on or derived from Site for use for other than a legitimate and bona fide business purpose.

The use of a password created by Authorized User does not create a right of privacy to Authorized User. Passwords are designed to minimize unauthorized access. Authorized User shall keep password, created to access the Site, strictly confidential.

All material contained in this Site is protected by law, including, but not limited to, United States copyright law and worldwide copyright and treaty provisions. Except as indicated, the entire contents (including images, text, and look and fee attributes) of the Site are owned and copyrighted by RCIS.

You agree not to interrupt or attempt to interrupt the operation of the Site in any way. You may use this site only for lawful purposes and in a manner which does not violate the rights or interests of others. The posting of any unlawful, threatening, libelous, defamatory, obscene, inflammatory, scandalous, pornographic, or profane material, or of any other content that could give rise to any civil or criminal liability under the law is strictly prohibited.

Confidentiality The Site contains information and offers capabilities to retrieve nonpublic information which RCIS and third parties may consider confidential, proprietary, and sensitive ("Confidential Information"). Confidential Information shall include all information gained as a result of access to the Site. Each Authorized User agrees that all information that it receives or creates by virtue of using the Site will be held in strict confidence.

You agree to abide by all additional restrictions displayed on the Site as the Site may be updated from time to time and further agree to prevent any unauthorized copying of any Site materials.

With the exception of applications commonly known as Web Browser software, or other applications formally approved by RCIS in writing, you agree not to use any software, program, application or any other device to access or log on to Site, RCIS's computer systems, or proprietary software or to automate the process of obtaining, downloading, transferring or transmitting any information or content to or from RCIS's computer systems, the Site or proprietary software.

Disclaimers of Warranty RCIS provides the information, text, and graphics on the Site as a convenience to the Students, staff and third party partners. This Site may include technical inaccuracies or typographical errors. RCIS reserves the right to make periodic changes to the information contained on the Site. RCIS also reserves the right to make changes in the hardware or software required to access the Site at any time.

RCIS DOES NOT WARRANT AND CANNOT GUARANTEE THE ACCURACY OR COMPLETENESS OF THE INFORMATION, TEXT, GRAPHICS, LINKS AND OTHER ITEMS RECEIVED BY YOU THROUGH THE SITE.

The jurisdiction and venue for any civil action arising out of this Site shall be in South Dakota or such other location as may be mutually agreed by the parties.

RCIS may make improvements and/or changes in the format or content of this Site at any time.
